Buenro is a platform designed to transform online connections into real-world encounters. Through our platform, Buenro offers users services to facilitate organizing and joining group-bookings of short-term rentals of properties, while easily handling invitations, communication, and cost splitting. We believe in fostering genuine connections through shared experiences in real life. The app is accessible only for users 21 and older.
These Terms of Use govern your access and use of our application and services. These Terms become effective and binding upon your acceptance, which occurs when you click to agree during the account registration process.
By accessing or using the App, you agree to be bound by these Terms of Use and our Privacy Policy.
If you engage in any financial transactions on the platform, you agree to be bound by our separate Terms of Service.

Definition of Terms
- "App” or “Platform": Refers to the Buenro mobile application and associated websites, services, and content.
- "User": Any individual who accesses or uses the App.
- "Content": Includes text, images, videos, audio, and any other materials displayed on the App.
- "Booking": The reservation of a Property or service by a Curator for a private group rental.
- "Property": Any accommodation listed on the App.
- "Property Manager": Refers to any User or 3rd Party Provider who lists a Property on the App.
- "Guest": Refers to any User who is participating in a group rental of a Property Booked through the App.
- "Group": Refers to the Curator and other Guests, including Plus Ones, who are part of a group- rental of a Property that is Booked by the Curator
- "Curator": Refers to a type of Guest for a Booking who agrees to assume full contractual responsibility for organizing and managing the Booking’s assigned Group before and during the dates of the contracted Booking. The Curator is the counterparty of the contract with the Property Manager for the specific Booking.
- "Inviter": Refers to a type of Guest who has sent an invitation to a Plus One / +1 and agrees to assume full financial responsibility for their portion of the Reservation costs on behalf of themselves and the invited +1 if the invitation is accepted.
- "Joining a Group": Refers to when Guests that are not the Curator elect to be added to an existing Booking initiated by a Curator. Joining a Group may entail obligations by the Guests.
- "Plus One / +1": Refers to a type of Guest who has received and accepted an invitation to join a Reservation with an Inviter.
- "Services": Refers to the features, tools, resources, and content provided by Buenro through its Platform. Buenro acts solely as a facilitation platform and is not the owner, manager, or operator of properties and does not provide rental, accommodation, or hospitality services.
- "Third-Party Providers": Refers to external companies or individuals that provide services used by the App (e.g., payment processors, mapping services).
- "Reservation": Refers to Users’ participation in the group stay rental of a Property, including the payment for their respective share of the cost. Users in the Curator role will have initiated a Booking of the Property, while non-Curator Guests will participate in the group stay by Joining a Group.
Onboarding
Eligibility:- To use the App, you must be at least 21 years old and legally capable of entering into a binding agreement.
- By creating an account, you represent and warrant that you meet these eligibility requirements.
- You acknowledge that the App facilitates real-life interactions between users, and therefore, providing accurate and truthful information during onboarding and maintaining an updated profile is crucial for the safety and security of all users.
- While Buenro implements Know Your Customer (KYC) procedures to verify user information, you understand that these procedures are not foolproof and that Buenro cannot guarantee the authenticity of all user profiles.
- By creating an account, you represent and warrant that you meet the eligibility requirements and that the information you provide is accurate and truthful to the best of your knowledge.
- You can create an account by providing your email address or by using your Google or Apple account credentials.
- You agree to immediately notify us at support@buenro.com of any unauthorized access to or use of your account. Buenro will not be liable for any loss or damage arising from your failure to protect your password.
- A verification code will be sent to the email address you provide. You must enter this code into the App to verify your account and proceed with onboarding.
- If you are not already on the waitlist, you will be added to the waitlist upon successful account verification.
- Your inclusion in, position on, and/or removal from the waitlist will be determined by Buenro, in its sole discretion.
- You will be notified via your registered email when you are granted access to the App.
- During onboarding, you must provide accurate and complete information, including your first and last name, age, a profile photo, gender, nationality, job title, and company name.
- You may have the option to sync your contacts to find friends on the App; this is optional and requires your explicit consent.
- Buenro is not responsible for the accuracy, completeness, or reliability of information provided by users. This includes, but is not limited to, user profile information and any other content generated by users or third parties. You acknowledge that you rely on such information at your own risk.
- Buenro reserves the right to suspend or terminate your account at its sole discretion, including, but not limited to, instances where your profile information is found to be inaccurate or misleading.
- You are responsible for maintaining the accuracy and completeness of your profile information.
- You agree to promptly update your profile if any information changes.
- You agree to use the Buenro Platform and Services for the intended purposes. The Buenro Platform offers Services that facilitate Users forming connections, including through Booking and/or Joining a Group rental. Buenro Services should not be construed as owning, managing, or operating of properties and does not provide rental, accommodation, or hospitality services
You agree not to engage in any of the following prohibited activities during onboarding or at any other time:
Misrepresentation and Deception:- Lie, misrepresent yourself or others, or create fake accounts.
- Attempt to evade enforcement of these Terms of Use , our Terms of Service, our Privacy Policy or our Community Guidelines.
- Curate any activity under another person's identity.
- Discriminate against or harass others.
- Behave disrespectfully or offensively in communications or interactions with others.
- Scrape, hack, reverse engineer, compromise, or impair the Buenro Platform.
- Use bots, crawlers, scrapers, or other automated means to access or collect data from the Buenro Platform.
- Hack, avoid, remove, impair, or circumvent any security measures protecting the Buenro Platform.
- Take any action that could damage or adversely affect the performance of the Buenro Platform.
- Use the Buenro Platform for any purpose other than its intended use as described in these Terms of Use.
- Use another User's personal information for anything other than facilitating a transaction on the platform.
- Use Buenro's messaging tools or Users" personal information to send commercial messages without their consent.
- Use Content from the Buenro Platform without permission from the Content owner or Buenro.
- Request, make, or accept a booking, reservation or payment outside of the Buenro Platform that can already be covered by the services we provide.
- Require or encourage Guests to interact with third-party websites or services without Buenro's authorization.
- Use the name, logo, branding, or others of Buenro without permission.
- Use or register any domain name, social media handle, or other source identifier confusingly similar to Buenro trademarks.
- Use, copy, display, mirror, or frame the Buenro Platform or any Content without Buenro's consent.
- Engage in any practices intended to manipulate Buenro's search algorithm.
- Offer Host Services that violate any applicable laws or agreements.
- Any unlawful activities based on the location of the property you are staying in.
- Organize or facilitate unauthorized parties or events at Stays.
- Violate any applicable laws, including privacy, data protection, and export laws.
- Provide someone else's personal information without authorization or in violation of applicable law.
- Fail to comply with Buenro's Terms of Use, Terms of Service, Additional Legal Terms, and Policies.
Profile and Settings
Profile Information:Your profile is your public face on Buenro! It displays the information you shared during onboarding and other details you choose to add. This includes:
- Basic Information: Your name, age, gender, nationality, and profile photo.
- About Me: A short description of yourself that you can create or edit.
- Professional Details: Your job title and company name.
- Social Links: Links to your Instagram.
- Accuracy of Information: You are responsible for maintaining accurate and up-to-date profile information. Since Buenro facilitates real-life interactions, providing truthful information is crucial for the safety and security of all users.
- Buenro's Disclaimer: Buenro is not responsible for the accuracy of the information displayed on your profile, including the validity of any external links you provide. You acknowledge that you own risk.
- Privacy Settings: You can adjust the privacy of your profile, making it visible to all users or only your followers. This allows you to control who can see your profile information.
Timeline: Your profile also displays your Timeline, a chronological feed of your upcoming travels and Buenro Reservations. This allows others to see your travel plans and potentially join your trips.
Burger Menu: The burger menu is your gateway to managing your Buenro experience. It provides access to various settings and features:
- Edit Profile: This is where you update all the information mentioned above in "Profile Information."
- Change Profile Photo: Upload a new photo to represent yourself on Buenro.
- Find Your Friends: Connect with friends who are already on Buenro by searching for them or uploading your contacts. You can also invite friends who are not yet on the platform to join Buenro and connect with you.
- Circles: View and manage your Circles, accept or decline Circle invitations, and manage your Circle requests.
- Add Trip: Add information about your upcoming trips, including the destination and dates. This information will appear on your Timeline.
- Edit Trip: Make changes to your existing trip information.
- Change Visibility: Adjust the privacy settings of your profile and Timeline to control who can see your information.
- Complete Your KYC: Complete the Know Your Customer verification process.
- Third-Party KYC Provider: Buenro uses a third-party provider, Onfido, for KYC verification. Buenro is not responsible for Onfido's procedures or data capture practices. Onfido will have its own disclaimers regarding data privacy.
- Security: Change your password, adjust invitation permissions, and manage blocked users. You are responsible for maintaining the security of your account and password.
- Account Privacy: Control the privacy settings for your account, including who can see your profile information and Timeline.
- Deactivate/Delete Account: Deactivate or permanently delete your account.
- Notifications: Adjust your app notification preferences to control what kind of notifications you receive from Buenro.
- Current Credit Balance: View your current credit balance, which can be applied to Reservations.
- Credit History: See a historical timeline of your credit earnings, showing how you earned each credit (e.g., referrals, promotions).
- Earn More Credits: Earn more credits for participating in eligible promotions.
- Manage Friends: View and manage your friends list, which consists of users you mutually follow.
- Manage Followers: View and manage your followers and follower requests. You can choose to accept or decline follower requests.
Timeline
Timeline Feature:The Timeline is a chronological feed that displays your upcoming travels and Buenro Reservations. It allows you to share your travel plans and connect with other users who might be interested in joining your trips.
Travel Information:You can add information about your planned travels, including the start date, city, country, and end date. This information is visible to other users based on your profile privacy settings (public or limited to followers/friends).
Booking Information:Your Timeline will also display the Reservations you are participating in, including the start date, city, country, end date, property details, and profile photos of other users in the Group. Reservations may include a "Join" button if there is space available for others to join and the privacy settings of the booking allows this.
Access to Group Dashboards:You can access the Dashboard for each of the Reservations you are participating in, from where you can check the status of your Reservation and other details such as other guests, cancellation policies, receipts, address, or access the group chat.
Privacy Settings:You can control the visibility of your travel and reservation information through your profile privacy settings. You can choose to make your Timeline public, or restrict it to your followers or friends, or just yourself.
Booking Visibility:By default, bookings that are full or that other users are not eligible to join will not be displayed on your Timeline. Additionally, Curators can set theirBookings to private, and you can choose to hide specific Reservations from your Timeline.
User-Generated Content:You are solely responsible for the content you post on your Timeline. You agree to comply with the following guidelines and restrictions:
- Do not post any content that is illegal, offensive, defamatory, or infringes on the intellectual property rights of others.
- Do not use the Timeline or Profile or Messaging to promote commercial activities outside of the Buenro Platform or spam other users.
- Respect the privacy of others and do not post personal information about others without their consent.
- Do not lie, misrepresent something or someone, or pretend to be someone else.
- Be polite and respectful when you communicate or interact with others.
- Do not scrape, hack, reverse engineer, compromise or impair the Buenro Platform
- You retain ownership of the content you post on your Timeline. However, by posting content, you grant Buenro a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content in connection with the App and its services. Buenro may use content to conduct its business activities, including but not limited to training, marketing, and resolving disputes.
- You represent and warrant that you have all necessary rights and permissions to post your content on the Timeline and that such content does not infringe on the intellectual property rights of any third party.
- Buenro reserves the right to remove any content from the Timeline that violates these Terms of Use or that we deem, in our sole discretion, to be inappropriate, offensive, or harmful.
- Buenro is not responsible for any user-generated content posted on the Timeline. We do not endorse or guarantee the accuracy, completeness, or reliability of any user content. You acknowledge that you use the Timeline and rely on user and property management content at your own risk.
- You agree to indemnify and hold Buenro harmless from any claims, losses, damages, liabilities, costs, and expenses (including attorneys" fees) arising out of or relating to your user-generated content on the Timeline, your use of the Timeline, or your violation of these Terms of Use.
Explore and Properties
Explore Feature:The Explore page is the central hub for searching and browsing available properties on Buenro. It provides a curated list of listings with key details to help you find the perfect accommodation for your next trip.
Search and Filters:You can refine your property search using various filters, including continent, dates (specific or flexible), destination (city and/or country), and price range.
Listing Information:Each listing on the Explore page displays essential information, including:
- Property photos
- City and country
- Price per room per night (or payment status)
- Available dates
- Option to "Curate" or "Join" a group
Clicking on a property card in Explore takes you to a detailed property page. While Buenro strives to provide accurate and up-to-date information, we rely on third-party property managers for this data. You acknowledge that:
- Buenro is not responsible for inaccuracies: Buenro is not liable for any errors, omissions, or outdated information on property pages, including but not limited to property details, amenities, availability, pricing, and house rules. You use this information at your own risk.
- Property managers are responsible for updates: It is the sole responsibility of the property managers to ensure the accuracy and timeliness of the information displayed on their property pages.
- Buenro makes no guarantees: Buenro makes no warranties or representations about the suitability, safety, or condition of any listed property.
- Buenro is not liable for events during stays: Buenro is not responsible for any events that occur during your stay at a property, including but not limited to Guest behavior, disputes between Guest, or issues with the property itself. Any concerns or complaints should be addressed directly with the property manager, and Buenro is not responsible for the property manager's response or actions.
The property page may display the following:
- Property Details: Guest capacity, number of bedrooms, number of beds per room, city and country.
- Dates: Check-in and check-out dates as selected during your search or exploration.
- Reservation Options: Choice to reserve just a room or the full home.
- Curator Disclaimer: If curating a group, a disclaimer like, "You'll Curate your group and claim the last room. Your group will have 7 days to claim the other fill rooms. Buenro won"t collect any payments until the last room is claimed." will be displayed. This clarifies the time limit for completing the group and finalizing the booking.
- Promotions: May include promotions and accompanying information. Clicking "Learn more" will provide details, terms and conditions about the promotion. Buenro reserves the right to modify or terminate any promotion at any time without prior notice.
- Other Groups: A list of other groups looking to reserve the same property around the same dates, including their booking visibility, data tied to complete the booking, profile photos of joined users, Curator name, booking dates, price per room per night, and a "Join" button. Please note that joining a group does not guarantee a confirmed reservation. The booking is only secured when the entire group is finalized and payment is processed. If another group completes their booking before yours, your reservation will be rescinded.
- Location: A Google maps with an approximate pin of the property's location. You acknowledge that the map location may not be exact, and Buenro is not responsible for any reliance you place on the displayed location. Exact location will be provided by the Property Manager after your Booking is complete.
- Stay Essentials: Check-in/out times, host language, house rules, safety considerations for amenities, and safety devices available on the property.
- Buenro House Rules: Clearly defined rules for all Guests, and guidelines for shared living.
- Cancellation Policies: Dynamically displayed cancellation policies based on the property manager's terms. Buenro is not responsible for any losses incurred due to cancellations, and you agree to resolve any cancellation-related disputes directly with the property manager.
- Amenities: A list of amenities available at the property. Buenro does not guarantee the availability or accuracy of listed amenities.
Third-Party Information: Buenro is not responsible for the accuracy, completeness, or timeliness of property information provided by third-party property managers. We act as a platform for listing properties and rely on property managers to provide updated and accurate information. You acknowledge that you use this information at your own risk.
Making A Booking and Pending Bookings
Curate a Group:
If you curate a group, you become the "Curator" and assume legal responsibility for the Booking, including:
- Contractual responsibility: You are the counterparty of the contract with the Property Manager or Host.
- Communication and Coordination: You are the primary point of contact for the group and responsible for communicating with other members, handling keys, coordinating check-ins and ensuring timely checkouts.
- Dispute Resolution: You are responsible for resolving any complaints or disputes that arise during the stay between Guests, Property Managers, Hosts, or third-party service providers.
- Damage Reporting: You are responsible for reporting any damages to the homeowner or property manager.
- Sharing Information: You allow your name, profile photo, and payment status to be available to relevant users based on the selected privacy settings of the booking.
- Maintaining Order: You are responsible for ensuring the safety of other Guests and all included furniture, amenities, etc., on the property. This includes ensuring no unregistered guests enter or stay on the property, and all visitors are cleared with other guests before entering the property.
- Managing Privacy: You are responsible for the privacy of the booking and the users that are a part of the Group on the Buenro platform. You are able to add and remove users from the Booking until it is confirmed.
- Enforcing House Rules: You are responsible for ensuring all Guests, including yourself, follow the house rules provided by the property manager.
- Transferring Curator Role: You understand that the role of Curator may be changed before the Booking commences. See our Terms of Service for more information. A Reservation for a Property Listing or Activity Listing cannot be confirmed and completed unless there is a Curator role assigned to the Group.
- All Guest responsibilities.
Join a Group: Joining a group means you'll be added to an existing booking curated by another user. You'll see the Curator's name and the number of other Guests.
Guest Responsibilities: As a Guest, you agree to:
- Payment: Pay your share of the group rental if not covered by any other User. You acknowledge this payment is not for a separate individual booking of a room but for your financial contribution to the private group rental booked by the Curator.
- Communication: Communicate any issues or needs to the Curator, including damages to the property, suspicious or illegal activity, or other incidents.
- Safety and Security: Ensure the safety of other Guests and all included furniture, amenities, etc., on the property.
- Guest Restrictions: Ensure no unregistered guests enter or stay on the property (for example, overnight), and all visitors are cleared with other Guests before entering the property.
- Compliance with Rules: Ensure all Guests, including the Curator, follow House Rules as supplied by Buenro and the property manager.
Proceed to Payment: After selecting a property and choosing to Curate or Join a Group, you'll proceed to the payment page. Here, you'll provide your payment details, which will be securely transmitted to our third-party payment processor. Refer to our Terms of Service for the terms and conditions that apply to the resulting transaction.
Third-Party Disclaimer: Buenro currently utilizes a third-party payment processor, to securely process payments. However, Buenro reserves the right to change payment processors at any time without prior notice. Buenro is committed to complying with PCI requirements when managing digital payments. The Curator acknowledges that Buenro is not responsible for any errors, delays, or actions of any payment that may affect the payment process.
Visibility Options: You can control who on the platform can see your status in the property reservation and group. Choose whether you want your reservation to be visible to everyone on Buenro, only to your followers, or just your friends.
Invite Others: You'll have the option to invite other people to join the reservation. If you"re a Curator, you can add to the group. If you"re already a Guest, you can invite a +1.
Manage Reservations: You can view and manage all the Reservations you are part of on the platform.
Curator Flow: The process is the same for Curators, including viewing pending bookings and managing the platform.
Terms of Service: Before submitting your payment, you must agree to the Buenro Terms of Service, which govern the terms and conditions of the transaction. It's important to read these carefully as they form a legal agreement between you and Buenro.
Credits, Discounts and Promotions
Credits, Discounts and Promotions: Buenro may offer various discounts and promotions in the form of promo codes, discount codes, or credits, which will be communicated via in-app notifications, email, or other promotional channels. These can provide percentage-based or fixed-amount discounts on reservation prices, platform fees, or a combination of both, per their applicable terms and conditions.
Earning Buenro Credits: Credits may be earned through temporary promotions. The availability, amount, and conditions for earning Credits are at Buenro's sole discretion and may vary by user, location, or time period.
Using Discounts and Promotions:Application of Discounts and Promotions will follow the terms and conditions published for the respective campaign or program.
Using Credits: Credits can only be applied toward your portion of a shared booking, meaning a service where the total cost is split among multiple participants. Credits cannot be used for:
- Buenro service fees, taxes, or other mandatory charges.
- Bookings where the user is paying the full cost alone (e.g., full-home bookings).
- Any third-party services that are not explicitly included in Buenro's Credits program.
Expiration and Limits: Expiration of Credits, Discounts, and Promotions are described below.
- Credits expire one year after they are earned, unless otherwise specified in a specific promotion. Expired Credits are removed from the user's account and cannot be reinstated.
- Discounts and Promotions expire according to their applicable terms and conditions.
No Cash Value: Credits, discount codes, and promo codes cannot be exchanged for cash or refunded to your bank account.
No Transferability: Credits, discounts and promotion codes cannot be transferred, gifted, or sold. Credits do not roll over if an account is closed or suspended.
Refunds & Cancellations: If a Booking is canceled where credits, discounts, or promo codes had been applied, the following terms will govern.
- Discounts and Promo Codes: If a booking is canceled, any discounts or promo codes applied to the original transaction will be revoked and will not be re-applied to any subsequent purchases, unless explicitly stated otherwise by Buenro. In the event of a cancellation, the value of the discount or promo code will not be refunded, and the user will be charged the full price for any future transactions.
- Credits: If a shared booking is canceled by the Property Manager, Guests or by Buenro, any Credits applied to that reservation will be returned to the user's account only if the cancellation is eligible for a refund under Buenro's cancellation policy. If a booking is partially refunded, Credits are always applied last—meaning any refunds will first return paid amounts in card payments before reinstating any used Credits (if applicable).
Buenro's Discretion: Buenro has full discretion over all promotions, including their validity, duration, and eligibility criteria. We reserve the right to determine whether a user's participation in a promotion warrants the associated discount or code. Buenro also reserves the right to modify or terminate the Credits program at any time without prior notice. If the Credits program is discontinued, any remaining Credits in user accounts will expire automatically, unless otherwise determined by Buenro.
Waiving Promotions: Buenro reserves the right to waive, modify, or terminate any promotional offer at any time for any reason, including but not limited to:
- Expiration of the promotion
- Suspected fraud or abuse
- Technical errors or glitches
- Changes in business needs
Fair Usage: Promotional codes and discounts are intended for legitimate use only. Attempts to abuse promotions in violation of their intended usage, such as applying the same code multiple times when it is intended for single use, may result in the invalidation of the discount, cancellation of the booking, or closure of your account.
Honoring Promotions: Buenro will honor promo codes and discounts based on their stated validity and published House Rules. Any technical errors or bugs that may inadvertently apply discounts beyond their intended terms do not guarantee the final application or use of the code. Buenro reserves the right to correct such errors and adjust the booking price accordingly.
No Property Rights or Guarantees: Discounts, promo codes, and Credits do not represent any ownership, property, or vested rights—they are a promotional feature and remain at Buenro’s discretion. Buenro does not guarantee the continued availability of discounts, promo codes, or Credits or their use in specific services.
Notifications
Notification Delivery Methods: Buenro may send you notifications through various channels, including push notifications within the app, emails to the address associated with your account, and potentially SMS messages to your registered phone number.
Third-Party Services: Buenro utilizes third-party services for the delivery of SMS and email notifications. While we select our partners carefully, Buenro is not responsible for any failures or delays in notification delivery caused by these third-party services.
Notification Types: Buenro may send you app, SMS, email notifications to enhance your experience and keep you informed about important information related to your account, activity on the platform, and your reservations. These notifications may include, but are not limited to:
- Reservation confirmations and updates
- Messages from other users
- Activity within your Circles
- Activity within your friends or other users’ activity
- Payment reminders
- Promotional offers
- Account activity alerts
- Updates to the platform or these Terms of Use
Purpose of Notifications
Notifications are intended to provide you with timely information and reminders to ensure a smooth and enjoyable experience on Buenro. They help you stay organized with your reservations, connect with other users, and manage your account effectively.
Notification Settings
You can manage your notification preferences in your profile settings. This allows you to control the types of notifications you receive, how you receive them (app or email), and the frequency of notifications. You can also opt out of specific notification types or disable all notifications entirely if you prefer.
Buenro's Responsibility
Buenro takes reasonable steps to ensure that notifications are sent in a timely and reliable manner. However, Buenro is not responsible for any losses, damages, or inconveniences arising from:
- Missed notifications
- Delayed notifications
- Inaccurate notifications
- Technical issues affecting notification delivery
- Your failure to manage your notification settings
User Responsibility
You are responsible for managing your notification settings and ensuring that you receive and review notifications in a timely manner. You acknowledge that relying solely on Buenro's notifications is not a substitute for actively managing your reservations, account, and activity on the platform. PLEASE BE AWARE THAT SOME NOTIFICATIONS MAY BE TIME-SENSITIVE, AND IT IS YOUR RESPONSIBILITY TO ENSURE YOU ARE AWARE OF SUCH NOTIFICATIONS TO AVOID MISSING IMPORTANT INFORMATION OR DEADLINES
User Responsibilities
In addition to the specific responsibilities outlined in other sections of these Terms of Use, you agree to the following general responsibilities when using the Buenro Platform:
- Legal Compliance: You will comply with all applicable laws and regulations when using the App. This includes laws related to data privacy, intellectual property, anti-discrimination, and online conduct.
- Accountability: You are responsible for all activities that occur under your account, including any actions taken by others who you allow to access your account.
- Accurate Information: You will provide accurate and truthful information when creating your account and using the App. This includes your profile information, reservation details, and any content you post.
- Respectful Conduct: You will treat other users with respect and courtesy. You will not engage in any harassment, bullying, discrimination, or other harmful behavior.
- Content Responsibility: You are responsible for any content you post or share on the App. This includes ensuring that your content does not violate any laws, infringe intellectual property rights, or contain offensive or harmful material.
- Security: You will take reasonable steps to protect your account and password from unauthorized access. You will notify Buenro immediately if you suspect any security breach.
- Intended Use: You will use the App for its intended purpose, which is to find and reserve accommodations and connect with other travelers. You will not use the App for any unrelated or inappropriate activities.
- Intellectual Property: You will respect the intellectual property rights of Buenro and other users. You will not copy, distribute, or modify any content from the App without permission.
- No Interference: You will not interfere with the operation of the App or its services. This includes any attempts to hack, introduce viruses, or disrupt the platform in any way.
- Prohibited Activities: You will not engage in any prohibited activities as outlined in these Terms of Use.
- Reporting Violations: You will promptly report any violations of these Terms of Use or any suspicious or harmful activity you observe on the platform to Buenro.
- Cooperation: You will cooperate with Buenro in investigating any suspected violations of these Terms of Use.
- Updates to Terms: You are responsible for staying informed about any updates to these Terms of Use. Your continued use of the App after any updates constitutes your acceptance of the revised terms.
Content and Intellectual Property
User Content: The Buenro Platform allows you to provide various forms of content, including feedback, text, photos, audio, video, and information ("Content"). By providing Content, you grant Buenro a non-exclusive, worldwide, royalty-free, perpetual, sub-licensable, and transferable license to use, modify, reproduce, distribute, and display such Content in connection with the Buenro Platform and its services. Buenro is also granted the right to use the Content for its business purposes, including but not limited to training, marketing, and dispute resolution.
- Personal Information in Content: If your Content includes personal information, it will only be used in compliance with applicable data protection laws and our Privacy Policy.
- Content Ownership: You retain ownership of the Content you provide. However, you warrant that you own or have the necessary rights to grant Buenro the license described above.
- Moral Rights: You waive any moral rights to your Content, including the right of attribution and the right to object to derogatory treatment.
- Content Responsibility: You are solely responsible for all Content you provide and are liable for any violations of intellectual property or privacy rights of third parties.
- Content Removal: Buenro reserves the right to remove any Content that violates these Terms of Use, infringes on intellectual property rights, or is otherwise deemed inappropriate.
- Content Policy: All Content must comply with Buenro's Content Policy and Privacy Policy, which prohibit discriminatory, obscene, harassing, deceptive, violent, and illegal content, among other things.
- Content Translation: You agree that Buenro may use automated tools to translate Content. Buenro does not guarantee the accuracy of translations, and you are responsible for confirming their accuracy.
Platform Content: The Buenro Platform contains content, including trademarks, designs, inventions, algorithms, computer programs, and marketing information ("Platform Content"), that is protected by intellectual property laws.
- Ownership of Platform Content: You acknowledge that all intellectual property rights for Platform Content are the exclusive property of Buenro and/or its licensors.
- Restrictions on Use: You may not use, copy, modify, or distribute Platform Content without the express written permission of Buenro.
- No Reverse Engineering: You may not reverse engineer the App or attempt to access its source code.
Feedback: Any feedback or suggestions you provide to Buenro become the property of Buenro, and you waive any rights to such feedback.
Third-Party Content: If the App displays any content from third-party sources, Buenro is not responsible for the accuracy or legality of such content.
License to Use the App: Subject to your compliance with these Terms of Use, Buenro grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:
- Download and use the Application on your personal device(s).
- Access and view Platform Content for personal and non-commercial use.
3rd Party Providers
Use of Third-Party Services: Buenro utilizes various third-party services to enhance your experience, deliver key features, and ensure the security and functionality of the App. These services include:
- Google and its associated products (e.g., Google Maps, Google Cloud Platform)
- Apple and its services (e.g., Apple Pay, iCloud)
- Amazon Web Services (AWS)
- Onfido (KYC verification)
- Stripe (payment processing)
- Intercom (customer communication)
- Property Management Systems
Data Security and Service Levels: Buenro selects third-party providers who adhere to high data security standards and comply with relevant data protection regulations. We also maintain Service Level Agreements (SLAs) with our key providers to ensure a certain level of service performance and availability.
User Discretion: You acknowledge that the use of some third-party services may be optional and at your discretion. When using these services, you are subject to their respective terms and conditions and privacy policies.
Buenro's Reliance on Third Parties: Buenro relies on these third-party providers to deliver a seamless and functional platform. However, Buenro is not responsible for:
- The availability, accuracy, or reliability of third-party services.
- Any loss, damage, or inconvenience caused by the actions or omissions of third-party providers.
- Any data collected or processed by third-party providers.
Disclaimer for Critical Services: Buenro utilizes third-party providers for essential functions such as payment processing (Stripe) and KYC verification (Onfido). While we select these providers carefully, Buenro is not responsible for any errors, delays, or actions of these providers.
Limitation of Liability: Buenro shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of third-party services integrated with the App, even if Buenro has been advised of the possibility of such damages.
Indemnification: You agree to indemnify and hold Buenro harmless from any claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of or relating to your use of third-party services in connection with the App.
Changes to Third-Party Providers: Buenro may change its third-party providers at any time. You will be notified of any material changes that may affect your use of the App or your data.
User Consent: By using the App, you consent to the use of third-party services as described in these Terms of Use.
Disclaimers and Limitations of Liability
No Warranty: THE APP AND ALL CONTENT AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BUENRO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
General Limitation of Liability: IN NO EVENT SHALL BUENRO BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, ANY CONTENT OR SERVICES PROVIDED THROUGH THE APP, OR THESE TERMS OF USE, WHETHER IN AN ACTION BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF BUENRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Exclusion of Certain Damages: SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Termination
Termination by Buenro:- Buenro may terminate your access to the App or your account at any time, with or without cause, and with or without notice.
- Causes for termination may include, but are not limited to, your violation of these Terms of Use, your misuse of the App, or your engagement in any fraudulent or illegal activity.
Termination by You: You may terminate your account at any time by following the instructions in the App's settings or by requesting it to Support via in-app Help Chat.
Effect of Termination : Upon termination, your right to use the App will immediately cease. Buenro shall have no obligation to maintain any of your data or content.
Governing Law and Dispute Resolution
Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of laws principles.
Dispute Resolution: Any dispute arising out of or relating to these Terms of Use or your use of the App shall be settled by binding arbitration in accordance with the rules of the Estonian Chamber of Commerce and Industry.
Changes to the Terms
Right to Modify: Buenro reserves the right to modify these Terms of Use at any time in its sole discretion. Any changes to the Terms of Use will be effective immediately upon posting the updated Terms of Use on the App.
Notification of Changes: Buenro may notify you of material changes to the Terms of Use by email or through the App. Your continued use of the App following the posting of any changes constitutes your acceptance of the modified Terms of Use.
Entire Agreement
These Terms of Use, together with the Privacy Policy and the Terms of Service (if applicable), constitute the entire agreement between you and Buenro relating to your access to and use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written.
Severability
If any provision of these Terms of Use is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while reflecting the original intent as closely as possible.
